Please read these Terms and Conditions carefully before using our website or booking an inspection. By accessing ehimaine.com or engaging our services, you agree to be bound by these terms. If you do not agree, please do not use our website or services.
1. Services Provided
Elevated Home Inspections, LLC provides residential and commercial property inspection services in Southern Maine and the Greater Portland area, including but not limited to: structural inspection, roof inspection, HVAC, plumbing, electrical systems review, radon testing, water quality testing, mold and spore detection, septic system inspection, sewer scoping, asbestos inspection, lead paint testing, termite and wood-destroying insect inspection, and associated specialty services.
A Master Electrician electrical review is included in all EHI inspection packages at no additional charge. The scope of this and all other services is described in the Inspection Agreement provided to you at the time of booking. In the event of any conflict between these Terms and the Inspection Agreement, the Inspection Agreement governs with respect to the specific inspection performed.
2. Booking and Scheduling
Inspections are booked through our online scheduling system (Acuity Scheduling) or by contacting us directly by email. A booking is not confirmed until you receive a written confirmation from EHI. We reserve the right to decline or reschedule bookings at our discretion.
We make every effort to begin inspections at the scheduled time. In the event of a delay or unforeseen conflict, we will notify you as promptly as possible.
We recommend booking at least 48 hours in advance. Same-week appointments may be available depending on schedule availability.
2.1 Cancellation and Rescheduling
If you need to cancel or reschedule your inspection, please contact us at office@ehimaine.com as early as possible. Late cancellations (within 24 hours of the scheduled inspection) may be subject to a cancellation fee as described in your Inspection Agreement. We understand that real estate transactions move quickly and will do our best to accommodate urgent rescheduling requests.
2.2 Property Access
You are responsible for ensuring that all utilities are active (water, electricity, and gas) and that all areas of the property are accessible at the time of inspection. This includes the attic, basement, crawl space, electrical panels, and all outbuildings. Areas that are locked, inaccessible, or blocked at the time of inspection will be noted in the report as uninspected. EHI will not be required to reschedule or refund an inspection due to inaccessible areas unless those areas represent a material portion of the property.
3. Inspection Reports
Inspection reports are delivered digitally within 24 hours of inspection completion, often the same evening. Reports are property-specific documents that identify observed defects, describe their significance, and provide recommendations. Reports reflect conditions observed on the date of inspection and are not a guarantee or warranty of any kind regarding the future performance, condition, or value of the property.
Inspection reports are prepared for the sole use of the client named in the Inspection Agreement. Distribution of the report to third parties (other than the client's real estate agent, lender, or attorney in connection with the subject transaction) requires written consent from EHI.
3.1 Scope Limitations
Our inspections are visual in nature. We inspect accessible, visible components of the property. We do not inspect behind walls, under flooring, beneath insulation, or within enclosed systems where access is not available. We do not move personal property, furniture, or stored items. Conditions that are concealed, inaccessible, or not observable at the time of inspection are outside the scope of our services.
Specialty services (radon, water quality, mold, asbestos, lead paint, septic, sewer scoping, WDI) are subject to additional scope limitations described in the Inspection Agreement and relevant test documentation.
4. Limitation of Liability
To the fullest extent permitted by applicable law, EHI's total liability to you for any claim arising from or related to an inspection shall not exceed the fee paid for that inspection.
EHI is not liable for:
Conditions that were concealed, inaccessible, or not observable at the time of inspection
Defects that developed or became apparent after the date of inspection
Consequential, incidental, indirect, or punitive damages of any kind
Loss of use, loss of profits, or diminution in property value
Third-party claims arising from your reliance on the inspection report
Some jurisdictions do not allow limitations on liability. If applicable law in your jurisdiction restricts these limitations, they apply to the maximum extent permitted.
5. Payment
Payment for inspection services is due at the time of booking or prior to report delivery, as specified in the Inspection Agreement. We accept payment through Squarespace Payments. By submitting payment, you agree to Squarespace's payment terms and authorize EHI to charge the amount corresponding to your selected inspection package.
All fees are stated in U.S. dollars. Pricing is subject to change. The price quoted at the time of booking applies to your scheduled inspection.
Refunds are handled in accordance with the cancellation and refund terms set forth in your Inspection Agreement. If you have questions about a charge, please contact us at office@ehimaine.com.
6. Use of Website
By accessing ehimaine.com, you agree to use the website only for lawful purposes and in a manner that does not infringe the rights of others. You may not:
Attempt to gain unauthorized access to any portion of the website or its underlying systems
Use automated tools to scrape, crawl, or extract data from the website
Submit false, misleading, or fraudulent information through any form or booking tool
Use the website to transmit spam, malware, or any harmful content
We reserve the right to restrict or terminate access to the website for any user who violates these terms or uses the site in a manner we deem harmful or inappropriate.
7. Intellectual Property
All content on ehimaine.com — including text, graphics, logos, photographs, and inspection report formats — is the property of Elevated Home Inspections, LLC or its licensors and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or use our content for commercial purposes without written permission.
Inspection reports delivered to clients are licensed for personal use in connection with the subject real estate transaction. They may not be resold, published, or distributed without prior written authorization from EHI.
8. Disclaimer of Warranties
Our website and services are provided "as is" and "as available." EHI makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any content on the website or information contained in inspection reports. Use of our website and services is at your own risk.
We do not warrant that the website will be uninterrupted, error-free, or free from viruses or other harmful components. We reserve the right to modify or discontinue any portion of the website at any time without notice.
9. Third-Party Platforms
Our website and booking system integrate with third-party platforms including Squarespace (hosting, forms, and payments) and Acuity Scheduling. Your use of these platforms is subject to their respective terms of service and privacy policies. EHI is not responsible for the terms, practices, or data handling of third-party service providers.
10. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of the State of Maine, without regard to conflict of law principles. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Cumberland County, Maine.
Before initiating any legal action, you agree to contact EHI in writing at office@ehimaine.com and allow at least 30 days for us to attempt to resolve the dispute informally.
11. Changes to These Terms
We may update these Terms and Conditions from time to time. When we do, we will revise the effective date at the top of this document. Your continued use of our website or services after any change constitutes your acceptance of the updated terms. We encourage you to review this page periodically.
